Complaint against BJP member Kapil Mishra for communal tweet on Diwali

A complaint was filed against BJP leader Kapil Mishra on Monday for allegedly mocking Muslim community.

Mishra took to Twitter, the micro-blogging site, to post a message which was allegedly insulting to the community.

Mishra tweeted in Hindi: "Pollution kum karna hai to ... yeh wale patakhe kum karo, Dilwali ke patakhe nahin (' If you want to reduce pollution, you have to reduce these crackers, not the Diwali crackers. He tweeted along with an image that showed a few members of the Muslim community.

Mishra's tweet came following Diwali as the air pollution escalated in Delhi-NCR. Nevertheless, after attracting negative press on social media, the BJP lawmaker later removed the post.

Mahmood Ahmed, a Joga Bai Extension resident, filed a complaint at the Jamia Nagar Police Station requesting the registration of an FIR under the relevant sections of the Information Technology Act and the Indian Penal Code.

Saket Gokhale also filed an FIR regarding the same matter under relevant sections.

He claimed that Mishra's tweet was allegedly aimed at "creating enmity, hatred and violence against the community."

"This is to bring to your notice that Mr Kapil Mishra, leader of the Bharatiya Janata Party in Delhi, made inflammatory comments via his Twitter handle on 28 October 2019 targeting the Muslim community: @KapilMishra IND," read the complaint.

"This content is inflammatory, unacceptable and seeks to create enmity, hatred and communal violence. It is demeaning, degrading and obscene, will corrupt minds and seriously affect religious sentiments. It may lead to illogical and dangerous consequences," it said.

Kapil Mishra, a former AAP MLA disqualified as a member of the Delhi Legislative Assembly, struck back saying that he had posted only pictures of children but "they see them as Muslims.” “In my tweet, there is no mention of Hindu or Muslim. If the picture were a Hindu family, they would have reacted in the same way," he later tweeted.
